Booking and transport conditions

Sun Ferry Oy is not liable to compensate the customer for any damage or expenses caused by natural conditions, such as unexpected weather variations. Sun Ferry Ltd reserves the right to cancel the booking in case of force majeure. In this case, the customer is entitled to a full refund. Sun Ferry Ltd may also cancel the booking if the payments for the booking are not paid on time.

Booking and transport conditions for charter cruises

1. Sun Ferry Oy booking and cancellation conditions

Sun Ferry Oy will comply with the following conditions when booking vessels and cancelling reservations. These conditions become binding on both parties when the customer confirms the booking in writing by the due date. The customer must cancel a booking that he/she does not intend to use.

1. Basic rent

Corporate and public sector customers we will invoice you after the event. You can also pay in advance by invoice or card at the bar on board.

From individual and association customers we charge the price of the rental fee as a booking fee. The charter fee must be paid 14 days before the cruise. By special arrangement, we also accept cash and card payment on board or invoicing afterwards. We reserve the right to check your credit details when paying in arrears. The vessel will not depart until the payment of the charter fee has been received or the invoice has been accepted. Sun Ferry Ltd reserves the right to cancel the contract if the agreed booking fee is not paid by the due date. The booking fee will be taken into account in the final invoice.

2. Food and drink offerings

On-board catering is always ordered and specified in advance, at least 14 days before departure. The number of persons indicated by the customer 7 days before the cruise is the basis for invoicing the catering. Beverages are charged according to actual consumption, wines according to opened bottles.

Corporate and public sector customers catering will be charged after the event or by card to the ship's bar. Private and association customers food and beverage services can be invoiced in advance once the number of persons and the number of portions to be invoiced is known. We reserve the right to check credit information when invoicing afterwards. Service can also be paid for at the ship's bar.

3. Payment instruments, payment terms and pricing

In addition to cash, the most common debit and credit cards accepted on board are Visa, Eurocard, Mastercard, Visa Electron and Amex.

Payment by invoice according to the terms of the agreement. General payment term 14days/net. If there is less than 14 days before the start of the cruise, the payment term may be shorter.

Invoice surcharge 7 euros. Interest on late payment according to the Interest Act.

The right to change prices is reserved.

The cancellation date is the date on which Sun Ferry Oy is notified of the cancellation. If the customer proves that the cancellation was sent in time to arrive at the intended time, the cancellation will be accepted even if it is late or does not arrive at all.

If the customer cancels the confirmed booking of the vessel, the price of the charter fee will be charged as follows:

  - Cancellation 0-60 days before cruise, charge 100 %

If the customer cancels subscribed catering services, they will be charged according to the quantity and price indicated in the order confirmation as follows:

  - Cancellation 0-7 days before cruise, charge 100 %

  - Cancellation 8-14 days before cruise, charge 50 %

The conditions of carriage apply to the carriage of passengers and cargo. Sun Ferry Oy's liability is limited under the Finnish Maritime Law.

  1. The freight forwarder is Sun Ferry Oy. The contract of carriage is between the carrier and the passenger.
  2. The passenger is obliged to comply with the ship's rules of order and safety during the transport.
  3. The carrier is liable for personal injury to a passenger caused by an incident occurring during the journey, if the injury is due to the fault or negligence of the carrier or someone acting under his responsibility. The same applies to loss of luggage and damage caused by the delay of the passenger.
  4. The passenger must prove that the damage caused to him or his luggage is due to the fault or negligence of the carrier or persons acting under his responsibility.
  5. The liability of the carrier is limited to one passenger per voyage and to all damages occurring during the same voyage, according to Chapter 15.15§ of the Finnish Maritime Act:
    SDR 175 000 for personal injuries
    4 150 SDRs for a delay in the transport of a passenger
    1 800 SDRs in the event of loss, damage or delay of baggage
    10 000 SDRs per vehicle
    2 700 SDRs in the case of loss, damage or loss of other baggage.
    The carrier may also invoke the overall limits of liability under Chapter 9 § 5 of the Maritime Act. Passenger deductibles:
    20 SDR for baggage and delay damage
    150 SDR for motor vehicle accidents
    The Special Drawing Right (SDR) is the unit defined by the Interbank Currency Fund and the exchange rate on 4 October 2013 was 1 SDR = €1.1321.
  6. The freight forwarder is not responsible:
    personal injury or damage to hand luggage and delay before the passenger has embarked or the hand luggage has been brought on board, or after the passenger has disembarked or the hand luggage has been removed from the ship.
    money, securities, works of art or valuables.
  7. The ship's officers and crew and others for whom the carrier is responsible are also entitled to the above limitations of liability and indemnity.
  8. Actions in matters governed by these conditions must be brought in the maritime court of the court of appeal for the district in which the carrier is domiciled or in which he principally carries on business.
  9. In all other respects, the provisions of the Finnish Maritime Act apply.

Any complaints must be made immediately to the staff or crew member. Every effort will be made to deal with complaints immediately.

If this is not possible, if the matter is not resolved satisfactorily or if it involves a claim for compensation, the complaint must be sent in writing within one month of the event to: sunlines@sunlines.fi.

Sun Ferry Oy allows one month (30 days) for the processing of complaints.
